Proshoto — AI Professional Headshots

1. Agreement to Terms

By accessing or using Proshoto ("the Service"), operated at proshoto.com, you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service.

2. Description of Service

Proshoto is an AI-powered headshot generation service. Users upload personal photos which are used to train a custom AI model, which then generates professional headshot images. The Service is provided on a credit-based system.

3. User Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when creating your account.

4. Credits and Payments

Credits are purchased through our payment processor, LemonSqueezy. Each credit allows you to train one AI model and generate a set of headshots. Credits are non-transferable and do not expire. All prices are listed in USD. Payments are processed securely by LemonSqueezy.

5. User Content

By uploading photos to the Service, you represent that you have the right to use those images and that they do not violate any third-party rights. You retain ownership of your uploaded photos. You grant Proshoto a limited license to process your photos solely for the purpose of providing the Service. Uploaded photos are used only for model training and are not shared with third parties.

6. Generated Content

You own the AI-generated headshots created through the Service. You may use them for personal or commercial purposes, including professional profiles, social media, resumes, and marketing materials.

7. Prohibited Uses

You may not use the Service to: generate images of people without their consent; create deceptive, harmful, or illegal content; upload images containing minors; reverse-engineer or attempt to extract the AI models; resell or redistribute the Service; or violate any applicable laws or regulations.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to modify, suspend, or discontinue the Service at any time with reasonable notice.

9. Limitation of Liability

The Service is provided "as is" without warranties of any kind. Proshoto shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

10. Changes to Terms

We may update these Terms from time to time. We will notify users of material changes by posting the updated terms on this page. Continued use of the Service after changes constitutes acceptance of the new terms.
